Come to divorce, the custody, care and control of children (CCC) are very important to the spouses with children as they have to decide the custody, care and control of the children.

What are the differences between custody, care and control?

Custody refers to the physical location of the children, care meaning who take care of the children. Control means the right to determine all questions relating to the upbringing and education of the child.

Custody, care and control of children in Mutual Divorce

In mutual divorce, both parties can decide the custody, care and control of the children freely. Both parties can sit down and discuss the arrangement of the children. In mutual divorce, if both parties are still in talking terms, normally we would advise the parties to have joint custody, care and control. This is because we always tell client divorce shall not affect the welfare of the children.

Party can also grant sole custody, care and control to another party if the said party is too busy or does not have any capabilities to take care of the children.

Custody, care and control of children in Unilateral Divorce

In unilateral divorce, both parties freely to request the type of custody, care and control they desire but the deciding right lies in the hand of the Judge. After perusing the documents and evidence, the Court will decide the type of custody, care and control in the best interest of the children.
